Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “user”) and NFC Pages (“we,” “us,” “our”), governing your access to and use of our websites, applications, NFC tags, and related services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
1. Description of the Service
The Service allows users to associate NFC tags or scannable identifiers with web-based pages displaying content selected, created, and controlled entirely by the user. NFC tags may be scanned by any person with compatible hardware and internet access.
NFC Pages does not create, control, verify, monitor, or endorse user-provided content.
2. User-Generated Content and Public Disclosure
You are solely and entirely responsible for all content, data, information, text, images, links, and materials you publish or make available through the Service (“User Content”).
User Content may include, but is not limited to:
- Names or nicknames
- Phone numbers or email addresses
- Physical addresses
- Emergency or safety contact information
- Medical, identification, or descriptive information
- Information relating to adults, children, or pets
All User Content must be treated as public. Anyone who scans an NFC tag may view the associated page. NFC Pages cannot restrict, control, or identify who scans an NFC tag.
You acknowledge and agree that publishing User Content is done entirely at your own risk and that you should not include any information you do not want publicly accessible.
3. No Responsibility for User Content
NFC Pages does not review, validate, or guarantee the accuracy, legality, safety, or appropriateness of User Content.
You agree that NFC Pages is not responsible or liable for any claims, damages, losses, injuries, or harm arising from User Content, including reliance on such content by third parties.
4. No Emergency, Safety, or Recovery Guarantee
The Service is not an emergency service, safety system, tracking service, or guaranteed recovery solution.
The Service may be unavailable, delayed, interrupted, or fail entirely due to maintenance, outages, third-party dependencies, network issues, or force majeure events.
NFC tags may become damaged, unreadable, incompatible, lost, stolen, or otherwise nonfunctional.
NFC Pages is not responsible for:
- Lost or unrecovered persons, children, pets, or property
- Failure to contact emergency or safety contacts
- Delayed, missing, or inaccessible information
- Physical injury, emotional distress, or death
- Any reliance on the Service in emergency or safety-related situations
You expressly acknowledge that use of the Service for identification, safety, or emergency purposes is done entirely at your own risk.
5. Service Availability Disclaimer
The Service is provided on an “as is” and “as available” basis.
NFC Pages makes no guarantees regarding uptime, availability, reliability, data persistence, or error-free operation.
6. NFC Hardware Disclaimer
NFC Pages does not control NFC scanning devices, operating systems, browsers, or third-party hardware.
Environmental conditions, misuse, device limitations, interference, or software incompatibilities may prevent NFC functionality.
7. No Warranties
To the maximum extent permitted by law, NFC Pages disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and safety.
8. Limitation of Liability
To the maximum extent permitted by law, NFC Pages shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, loss of profits, personal injury, property damage, or emotional distress.
NFC Pages’s total liability, if any, shall not exceed the lesser of:
- The amount paid by you to NFC Pages in the twelve (12) months preceding the claim, or
- $100 USD
9. Indemnification
You agree to indemnify, defend, and hold harmless NFC Pages and its owners, officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your failure to comply with applicable laws, including child privacy laws
10. Children’s Online Privacy Protection Act (COPPA)
10.1 No Directed Collection
The Service is not directed to children under the age of 13. NFC Pages does not knowingly collect personal information directly from children.
10.2 User Content Involving Children
Users may voluntarily publish content relating to a child, including names or emergency contact information. Such content is User Content and is publicly accessible.
10.3 Parental Responsibility and Consent
If you publish information relating to a child under 13, you represent and warrant that you are the child’s parent or legal guardian, or that you have obtained verifiable parental consent as required by COPPA.
NFC Pages does not verify parental consent and does not act as a custodian of such consent.
10.4 No Liability for COPPA Violations
NFC Pages is not liable for any COPPA violations arising from User Content. You agree to indemnify NFC Pages from any claims, penalties, damages, or regulatory actions resulting from your failure to comply with COPPA.
10.5 Reporting Child-Related Content
Concerns regarding child-related content may be reported to [email protected]. We may, at our discretion, remove or restrict access to content.
11. Prohibited Use
You agree not to use the Service for any illegal, unlawful, harmful, or abusive purpose, including harassment, impersonation, fraud, or violations of privacy or child protection laws.
12. Suspension and Termination
NFC Pages may suspend or terminate access to the Service at any time, with or without notice, for any reason, including violation of these Terms or risk to the platform.
13. Changes to the Service or Terms
NFC Pages reserves the right to modify or discontinue the Service or these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Illinois, United States of America, without regard to conflict-of-law principles.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
